Terms of Use
CyberPatient and CP OnCall
Effective date: September 25, 2026
About these terms
These Terms of Use govern the CyberPatient websites, the CyberPatient institutional learning platform and CP OnCall, our service for individual learners. They are an agreement between you and Interactive Health International Ltd. (IHI, CyberPatient, we, us or our). CP OnCall is also referred to as OnCall by CyberPatient.
When you accept these Terms during registration or checkout, they apply together with the plan details and order confirmation provided to you. Please read them before agreeing. Our Privacy Policy explains how we handle personal information. It is not permission for uses of information that require separate consent.
If your institution provides your access, its signed agreement with IHI controls institutional purchasing, administration and any conflicting service terms. Your institution may also have rules for coursework and assessment. These Terms do not remove rights that applicable consumer or privacy law gives you.
Educational use and AI limitations
CyberPatient and CP OnCall provide simulated clinical learning experiences. They are not medical care, medical advice, a clinical decision-support service or a substitute for supervised training. Do not use a simulation, score or AI response to diagnose or treat a real person. Participation does not grant a professional qualification or guarantee an examination result.
AI-assisted history-taking and communication features generate simulated responses that may be inaccurate, incomplete or inconsistent. Review them critically and use appropriate educational references and faculty guidance. Do not enter real patient information, identifiable clinical records or confidential information about another person.
Research described on our websites concerns the study populations, teaching methods and outcomes stated in the linked publications. It is not a promise that an individual learner will obtain the same result.
Accounts and access
You must have the legal capacity to accept these Terms. If you do not, a parent, guardian or institution must provide any legally required authorization before you use the service. The service is intended for health-profession education, not for children.
Provide accurate account and billing information, keep your login credentials private and tell us promptly if you suspect unauthorized access. Individual accounts are for one learner and may not be shared or resold. Institutional accounts must be used within the institution’s licence and assigned permissions.
You need a compatible device, supported browser and internet connection. Any additional technical requirements will be stated before purchase. Your institution may determine when its sponsored access begins or ends.
Plans and AI usage
Your plan description and order confirmation identify the case access, AI allowance, term and other features included in your purchase. Free access is limited to the allowance stated when you register.
A free account does not become a paid subscription unless you expressly choose and authorize a paid purchase.
Where a plan offers unlimited case attempts, this means repeated personal practice with the cases included in that plan during its access period. It does not mean unlimited AI encounters, unrestricted access to every feature or permission to share an account.
AI history-taking is included where stated in your plan, subject to the allowance and reasonable-use conditions disclosed before purchase. We may apply proportionate safeguards against automated, shared or abusive use. Any numerical allowance, reset period or paid overage must be disclosed before it applies; no extra AI charge is authorized by these Terms alone. Changes that reduce a paid entitlement are subject to the protections in the Changes section below.
Purchases and payment
Individual plan prices are in US dollars unless checkout expressly states another currency. Before you pay, checkout must show the plan, access period, amount payable, applicable taxes, billing frequency, any promotional conditions and whether the purchase renews automatically. Your bank may apply its own conversion rate or fees.
Payments are processed through Stripe or the payment provider identified at checkout. You authorize only the charge and any recurring payments expressly presented and accepted there. We will provide an order confirmation and a copy of the applicable contract in a form you can retain.
Unless your order states a later start date, paid access starts when payment succeeds. If account setup is still needed, follow the instructions in your confirmation. Contact info@cyberpatient.ca promptly if you cannot access a paid plan.
A plan upgrade is a separate purchase or subscription change that requires your authorization. Any credit, prorating, replacement of the existing plan and new renewal date must be explained before you confirm. A promotional price does not imply a permanent renewal price unless the offer expressly says so.
Renewal and cancellation
Monthly and Annual plans renew only if you expressly accept automatic renewal at checkout. A one-time Exam Sprint or Clinical Years purchase expires at the end of the purchased term and does not automatically renew. The order confirmation states the applicable dates.
You may cancel a subscription renewal at any time, before or after renewal, without a cancellation fee. Use the cancellation option made available in your account, or email info@cyberpatient.ca with enough information to identify your subscription. Email is a valid route even if you cannot sign in. We will confirm the cancellation and stop future renewal charges.
Unless a refund or earlier termination is required by law, cancelling renewal leaves access in place through the paid period. Deleting an app, stopping use or closing a browser does not notify us to cancel. If you ask us to close your account, we will also address any active subscription.
Where British Columbia’s subscription protections apply, renewals longer than 60 days require notice 30 to 60 days before renewal. The notice will state the renewal date, cancellation rights, how to cancel and that renewal occurs if you do not respond. If you cancel a covered renewal after it occurs, we will provide the legally required refund for unused services within 15 days and cancel payment authorizations within the statutory period. Covered shorter renewals may be cancelled without a fee but do not carry a statutory refund for unused time solely because of that cancellation. Other applicable consumer protections remain in effect.
Refunds
You may request a full refund of your first paid CP OnCall purchase within 14 calendar days of that purchase. Email info@cyberpatient.ca from your account email address, or provide the receipt or other information that lets us identify the payment. This first-purchase refund is available once per person and is not conditional on having left the service unused.
Renewals and later purchases do not receive a new 14-day voluntary refund window. Except where applicable law requires otherwise, they are non-refundable. This does not limit refunds for covered subscription renewals, faulty or undelivered services, unauthorized charges or any other non-waivable right.
An eligible first-purchase refund cancels the refunded paid access and associated future renewals.
We will issue the refund to the original payment method within 14 days of receiving an identifiable request; bank posting times may vary. If law requires a different deadline or method, that rule applies.
Institutional refunds are governed by the institution’s agreement and applicable law.
Acceptable use and intellectual property
We grant you a limited, non-exclusive right to use the service for your own learning, or for authorized teaching under an institutional licence, while your access remains valid. IHI and its licensors retain ownership of the software, simulation cases, graphics, trademarks and other service materials.
Do not copy or redistribute our case library; sell access; bypass access or usage controls; scrape or automate the service without written permission; introduce malicious code; disrupt other users; or use the service unlawfully. Restrictions do not prevent activities that applicable law expressly permits.
You retain any rights you have in material you submit. You give us permission to process it only as reasonably necessary to provide, secure and support the service and as described in the Privacy Policy. This is not an unrestricted licence to sell your material or train unrelated AI models on it. Do not submit material you lack permission to use.
Institutional learning records
If you join an institution’s classroom, authorized faculty or administrators may be able to see activity, submissions and results associated with that classroom. Your institution determines how it uses those records for teaching or assessment. Ask your institution about its access rules and assessment decisions.
Linking an individual account to an institution may change who can access the records associated with that institution. We will explain the relevant sharing before the link is made. Personal data rights and the handling of institutional records are described in the Privacy Policy and the applicable institutional agreement.
Availability and suspension
We aim to provide a reliable service, but maintenance, outages and third-party failures can interrupt access. We do not promise uninterrupted availability. Tell us about a problem at info@cyberpatient.ca so we can investigate.
We may restrict or suspend access where reasonably necessary to address a security threat, fraud, unlawful activity, non-payment or a material breach of these Terms. We will explain the reason and provide a reasonable opportunity to resolve it where practicable, unless doing so would create a security risk or be unlawful. You may ask us to review a suspension.
If we permanently discontinue a paid service for reasons unrelated to your breach, we will provide reasonable notice and a proportionate refund for the unprovided paid service, or another remedy you agree to. Any stronger rights under law or an institutional agreement continue to apply.
Changes to the service or terms
We may update educational content and make technical changes that do not materially reduce your purchased access. We will not use a website update alone to impose a new charge, reduce a committed paid entitlement or weaken an agreed cancellation or refund right.
Material changes to a paid contract require the notice and consent required by applicable law. If a change requires a new agreement, we will ask you to accept it. We will tell you about any proposed renewal-price change before you must decide whether to renew. Mandatory cancellation and refund rights apply if a change adversely affects you.
Revised website terms will carry an updated effective date. They do not retroactively replace the terms of an existing purchase.
Responsibility and disputes
We will provide the service with reasonable care and skill. Educational content and AI output do not carry a guarantee of clinical accuracy, examination success or suitability for real-patient care. To the extent permitted by law, we do not provide additional implied warranties beyond those expressly stated or required by law.
To the extent permitted by law, neither party is liable under these Terms for indirect or consequential loss that was not reasonably foreseeable when the contract was made. This does not exclude liability for fraud, wilful misconduct, gross negligence, personal injury caused by negligence, or any responsibility that law does not allow to be excluded.
British Columbia law and applicable Canadian federal law govern these Terms, subject to the mandatory protections of the place where you live. You retain any right to bring a claim in a court or tribunal available under applicable law, participate in a class proceeding, contact a regulator or publish an honest review. These Terms do not require arbitration.
